1 - Area of applicability
These terms and conditions apply to every offer of the entrepreneur - TyreCompany United Kingdom - and every contract between businesses and consumers through a distance.
The client is a consumer, when during the conclusion of the contract, the purpose of the goods and services ordered can not be included into commercial or professional activities.
Differing, conflicting, or additional terms of the consumer are not part of the contract.
2 - Conclusion of the contract
Via our Internet portals you may order the listed items using an Internet form or via fax and telephone respectively. By providing the details as required as part of the order process and by sending this order in you submit binding offer; in this connection the order via telephone, fax or internet have the same legal validity. By ordering you firmly declare to accept these General Terms and Conditions and that you wish to acquire the ordered goods. We will confirm your incoming order with a formal acknowledgement of receipt; this acknowledgement of receipt is not an acceptance of your order. The contract takes effect from receipt of the goods with your approval, at the latest, however, after the expiry of the return period of 14 days.
3 - Cancellation policy
You may revoke your contractual declaration within fourteen days without prividing reasons. The period commences on the day you, or a third party named by you, other than the carrier, have taken physical possession of the goods. To exercise your right of cancellation, you must inform us by means of a clear statement (e.g. consigned by post, fax or email) of your decision to withdraw from the contract. Effects of withdrawal
When you withdraw from the contract, all payments we have received from you will be repayed immediately, no later than fourteen days from the date on which the notice of the cancellation of the agreement has been received by us. For the repayment, the same method of payment will be used that has been used for the original transaction, unless otherwise has been agreed expressly. TyreCompany will not be charged for the costs for a repayment.
The goods will be picked up by us. TyreCompany will not bear the costs of returning the goods. The consumer is responsible for any diminished value of the goods when such loss in value is due to an unnecessary nature.
The consumer's right of cancellation expires in case of fully mounted products (purchase of complete sets) prematurely. The right of withdrawal expires for goods that are executed according to customer specifications. This includes all supplies of complete sets, which are produced according to a customer's wishes.
4 - 30 day redemption offer
TyreCompanny offers customers, regardless of legal requirements, a voluntary right of return in according with the following provisions.
The customer can make use of the voluntary right of return within 30 days from receipt of goods. This requires that the constumer has contacted TyreCompany within this time limit and returns the goods in full and in unused and undamaged condition to the return address communicated to him by TyreCompany.
In case of a return in accordance with the conditions set out above, the customer will be refunded with the already paid purchase price. The customer bears the risk of transportation. Please be sure to repack your items carefully.
This voluntary right of return does not limit your legal rights including your right of withdrawal.
Goods which are designed to customers' specifications are excluded from our 30-day right of return as well as from the right of withdrawal. These include in particular the supply of complete wheels that we perform individually for each customer. The withdrawal shall be without any legal obligation and hereby exclusively on payment of the contracted fee of 30 GBP per complete wheel.
5 - Prices, shipping costs and payment
All prices shown on TyreCompany.com are inclusive of VAT, unless otherwise agreed.
At TyreCompany, delivery is always without shipping costs.
For payment, the agreed and specified ways of payment can be used.
Unless otherwise agreed, the pruchase price shall be paid within 10 days of receopt of the call; the date of payment receipt is decisively at TyreCompany.
6 - Delivery
Unless otherwise agreed, products will be delivered to the shipping address provided by the customer.
Delivery to Ireland, Northern Ireland, Scottish Islands and the Highlands, Isle of Man and Isle of Wight, and the Channel Islands is not available.
On the website, you will find on each product detail page information on availability of the products. All products shown on the website are directly available.
when the product ordered is not available, because we are not supplied with this product by our suppliers without fault, we can withdraw from the contract. In this case, we will inform you immediately and may propose to supply a comparable product. When no comparable product is available or when you do not wish to be supplied with a comparable product, we will refund the already paid money.
For entrepreneurs, the risk of accidental loss or deterioration of the goods is transferred to the entrepreneur once the shipment has been handed over to the executive of the transport company.
For consumers, the risk of accidental loss or deterioration of the goods is transferred to the consumer once the goods are delivered to the consumer.
With regard to the risk of loss, it is equal to the transfer, when the customer is in default of acceptance.
The customer assures to have specified the correct and complete delivery address when placing the order. When it is due to an incorrect address, additional costs - e.g. re-shipping costs - will be paid by the customer.
7 - Retention of title
TyreCompany retains title to the goods until full payment has been received. When the buyer is an entrepreneur, TyreCompany retains title to the goods until fulfillment of all claims against the pruchaser of the business relationship.
8 - Warranty
Any inquiries and / or complaints should be directed to TyreCompany using the contact details given in the imprint. Thre warranty on material defects and other defects is governed by the provisions listed below.
Technically related design or manufacturing changes and slight variations in the colour design may remain as long as this is reasonable for the buyer and these changes and deviations are commercially available.
In case of defects of the delivered goods, the customer shall initially only have a claim to subsequent performance. Customers have the choice of whether a remedy or a replacement delivery is to take place; However, TyreCompany is entitled to the type of post to be refused if it is only possible at disproportionate costs and the other type of performance without significant disadvantages for the customer.

For new products, the limitation period for a consumer in case of defects is two years and for entrepreneurs one year from the date of delivery.

TyreCompany is liable in the event of damage to the customer (a) from injury to life, body or health arising from a breach of duty by TyreCompany or its legal representatives or agents, (b) under the Product Liablility Act, from the provision of a guarantee or for fraudulent misrepresentation, (c) when TyreCompany or its legal representatives or agents have caused the damage with intent or gross negligence, and / or (d) when the damage is caused by the breach of an obligation of TyreCompany whose fulfillment the proper execution of the contract and on which the customer regularly trusts and may rely.
The liability provisions in the aforementioned paragraph also apply to the personal liability of officers, employees, and agenst of TyreCompany.
10 - Final provisions
British law applies to the exclusion of the UN Sales convention.
When any provision of these Terms and Conditions is wholly or partially invalid, the validity of the remaining provisions of this agreement, including the remaining terms and conditions shall not be affected. The statutory provisions shall replace the invalid provisions. This applies to the case that the terms and conditions should have an unforeseen gap.
